The agreement governing your access to and use of Scanna.

These Terms of Service (“Terms”) govern your access to, integration with, and use of Scanna, including our websites (scanna.xyz, app.scanna.xyz, api.scanna.xyz, mcp.scanna.xyz, docs.scanna.xyz), our Model Context Protocol (MCP) server, SDKs, and any related intelligence feeds (collectively, the “Platform”).

The Platform is owned and operated by Etherian LLC, a Wyoming limited liability company (collectively referred to as “Scanna,” “the Company,” “we,” “us”). By accessing, querying, or integrating with the Platform, you agree to be bound by these Terms. If you do not agree with any portion of these terms, you must immediately cease all access to our endpoints and infrastructure.

1. Nature of the Platform & No Financial Advice

Scanna is an open research and development platform. Endpoints and MCP swarms are provided strictly for analytical, educational, and experimental evaluation. We do not broker, host, execution-route, or facilitate any betting or trading, nor do we take custody of any assets, private keys, or digital wallets.

Scanna does not provide trading strategies, execution logic, or automated financial behavior. The Platform functions strictly as an information feeder. Nothing output by our API, MCP server, or documentation constitutes financial, legal, trading, or investment advice. You and your automated systems utilize these probabilistic insights entirely at your own discretion and risk.

The Platform operates fundamentally as a pattern-recognition engine ingesting volatile off-chain data that reflects rapidly evolving real-world events. You explicitly acknowledge and agree that AI-generated intelligence can contain errors, systemic biases, discrepancies, or hallucinations. You bear sole responsibility for verifying any output before your autonomous agents or automated scripts execute actions based upon it.

2. Fees, Enterprise Plans, and x402 Micropayments

  • Custom enterprise access may be granted under dedicated plans. Any Service Level Agreements (SLAs), performance uptime guarantees, or associated penalties established under an Enterprise Plan are structured strictly as service credits, are evaluated on a case-by-case basis, and shall under no circumstances exceed the total monetary value of that specific contract period.
  • For autonomous systems operating without pre-negotiated enterprise accounts, the Platform natively supports the x402 payment protocol. These micropayments settle programmatically on a blockchain network per query; they are final, irreversible, completely immune to chargebacks, and may incur non-refundable network fees.
  • We reserve the right to change endpoint pricing, microtransaction fees, or allocation models at any time with reasonable notice. Taxes are your sole responsibility.

3. Eligibility & Acceptable Use

Our Site is not intended for children under 18 years of age. You must have full legal capacity, and must not be a sanctioned person or accessing the service from a comprehensively sanctioned jurisdiction.

If you deploy any artificial intelligence agent, LLM-driven workflow, automated trading script, bot, or integration utilizing our API or the x402 payment protocol, you are legally considered the user and bear full responsibility and liability for all actions taken, fees incurred, and outcomes generated by your autonomous systems. The legal defense that “an agent did it” or “the model acted autonomously” is completely unrecognized under these Terms.

You agree to interact with the Platform exclusively through documented endpoints, SDKs, or the designated MCP server. You may not misuse our infrastructure by attempting to probe our systems for vulnerabilities, disrupt the x402 payment rails, introduce malicious code, or interfere with our ensembling framework. Any unauthorized interference will result in immediate termination of your access.

4. Intellectual Property & Commercial Partnerships

All architectural components, features, and code comprising the Platform—including our ensembling frameworks, continuous web-crawlers, intent decoding models, SDKs, and resulting predictive outputs—remain the exclusive property of Scanna, Etherian LLC, or its licensors.

Subject to these Terms, you are granted a limited, personal, non-exclusive, revocable, non-transferable license to consume this data for your personal or internal business use.

  • Unlike restrictive data silos, Scanna welcomes and is actively open to partners leveraging, sublicensing, reselling, commercializing, or redistributing our live intelligence feed or its predictive outputs. This includes utilizing our infrastructure to build competing analytics platforms, custom benchmarking services, or advanced forecasting products.
  • To support and coordinate these ecosystem integrations effectively, any such commercial redistribution, reselling, or competitive product development requires prior notice to and a formal agreement, contract, or explicit written consent from Scanna.

5. Limitation of Liability

The Platform and its data feeds are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We shall not be liable for any indirect, incidental, consequential, special, or punitive damages. Specifically, we bear no responsibility or liability for, without limitation:

  • Any lost profits, revenues, business opportunities, or trading losses incurred by your systems.
  • System crashes, downtime, operational failures, or context errors experienced by your integrated scripts, applications, hosting environments, or AI agents.
  • Service interruptions, transmission delays, or corrupted data signals caused by, but not limited to, external blockchain network failures, protocol exploits, or upstream data venue outages.

In no event shall our aggregate liability under any contract, tort, strict liability, or other legal or equitable theory exceed the greater of US$1 or the fees you paid us in the 1 month preceding the event giving rise to the claim.

6. Changes to Terms

As our machine-native infrastructure and prediction methodologies evolve, we reserve the right to update these Terms of Service. We will provide reasonable notice for material changes. Your continued integration with the Scanna MCP server, API, website, or SDKs following any updates constitutes your formal acceptance of the revised Terms.
